Contracts of sale concluded through electronic commerce between www.cuadrossplash.com and the consumer shall be governed by the following General Terms and Conditions of Contract.
1. Who is selling to you. The contract of sale is concluded with Impresión Store Talavera S.L., Tax Identification Code (Código de Identificación Fiscal) B75652354, with registered office at calle Santa Águeda 2 bis, LOCAL 2, 45600 Talavera de la Reina (Toledo). You can contact us by e-mail at cuadros@impresionstore.com or by telephone on 627 920 405.
2. Conclusion of the contract. By clicking the “Complete order” (or “Pay now”) button, you make a binding declaration of intent whereby you accept the conclusion of the order and undertake to pay for it. You will then receive an acknowledgement of receipt of your order, confirming the conclusion of the contract. Contracts concluded in the online shop are archived. You can access the orders you have placed from your customer account or by requesting them by e-mail.
3. Prices and VAT. The prices shown include the legally applicable Value Added Tax (VAT) and are stated in euros. Unless expressly stated otherwise, prices do not include delivery charges. Ownership of the product passes upon full payment of the price.
4. Delivery and delivery charges. Products are delivered to mainland Spain, the Balearic Islands, the Canary Islands, Ceuta and Melilla. The following delivery charges apply, regardless of the number of items: mainland Spain 12 €, the Balearic Islands 30 €, the Canary Islands 70 €, Ceuta and Melilla 70 €. In the Canary Islands, Ceuta and Melilla, where the purchase needs to be sent in more than one parcel, the transport company will be consulted to adjust the delivery price, and this will be confirmed to you before dispatch.
Parcels measuring 150 cm or more in any of their dimensions may be affected by the specific policies of the transport companies. Depending on the area, province or franchise, they may not be obliged to deliver them to the customer’s own front door, although they will deliver them to the building entrance.
5. Payment methods. The following payment methods are offered: credit or debit card, Apple Pay, Google Pay, Shop Pay, PayPal and bank transfer. If you select bank transfer, you will be sent by e-mail the details of the account to which you must make the transfer. Card payments are processed securely through Shopify Payments; Cuadros Splash does not see or store your card details.
6. Delivery time. The product will only be dispatched once payment for it has been received, within the delivery time indicated for each product, which as a general rule will be a maximum of 30 working days. During periods of high commercial activity — and not only at Christmas, New Year, Epiphany (Reyes) or Easter — delivery may take somewhat longer than the days indicated, and the transport companies may even delay delivery due to a build-up of shipments. If, for reasons beyond the control of Cuadros Splash, this time limit is not met, we undertake in any event to deliver the product within 30 days.
7. Transfer of risk. It is important that you inspect the parcel at the time of delivery and make any appropriate complaints and objections if you find that it is in poor condition or shows obvious damage caused during transport. In that case, note it on the delivery note or, if it is not possible to check the product, sign it as “pending inspection”. Then contact us at cuadros@impresionstore.com.
8. Damage and claims. If you receive your order and it shows any damage caused during transport, we ask you to notify us within 24 hours of receipt, by e-mail or by telephone, sending proof of it (photograph and description) together with your name and order number. This allows us to claim from the carrier, and the damaged item will be replaced for you at no cost. We are available Monday to Friday, from 10:00 to 14:00 and from 17:00 to 21:00.
All of the above is without prejudice to the three-year legal guarantee of conformity that the law grants you as a consumer: if the product does not conform to the contract, you may make a claim even after those 24 hours have passed.
9. Product information. Owing to the particular nature of our activity, we wish to state that the paintings may show slight variations from the images shown in the online shop. Our experience tells us that, depending on the device or screen, these differences may become more pronounced or fade away. The shade of some colours may be affected when converted to digital printing, but always very slightly: golds and silver tend to come out in more yellow and grey tones, and mauves may also show slight changes.
The products are paintings made by us, with canvas fabric on a wooden stretcher frame 3 or 3.5 cm thick and with the edges printed with a mirror effect. Eco-friendly, environmentally respectful, high-quality, UV-resistant inks are used.
The descriptions of the paintings refer to the original paintings, which, depending on the case, may feature textures, relief, brushstrokes, palette-knife or collage technique, washes, liners, varnishes, etc. What you are purchasing is a digital reproduction printed on canvas of a painted original (the one shown in the photo on the website) and, therefore, it has no relief or brushstrokes, unless you order the gel finish (reference SPA1605), which adds texture and relief to the print. Digital reproductions printed on canvas are always smooth.
On occasion, certain images have been created using digital techniques or digital painting, using digital design software and artificial intelligence. Some original painted works have been processed with this software to increase their resolution, change their colouring, enhance them or even transform them. Others have been kept fully in their original state for printing on canvas.
10. Errors in the information. Cuadros Splash reserves the right to reject any order placed under an explicit and unintentional error (misconfiguration of price tables, images, descriptions, data, etc.) due to computer errors, in which case it will refund the amount paid by the customer or offer the customer another alternative or solution.
11. Right of withdrawal. All paintings are made to order, after the order is placed and in the size and finish chosen by the customer: we hold no stock. For this reason, in accordance with article 103 c) of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (Spanish Consolidated General Act for the Protection of Consumers and Users), they are not subject to the right of withdrawal or to returns due to a change of mind. You may cancel the order and get your money back within 24 hours of payment by writing to us within that period; after that we start making it and it can no longer be cancelled. If the painting arrives damaged or with a defect, we will replace it at no cost (points 7 and 8), without prejudice to the three-year legal guarantee of conformity. 12. Customer acceptance. By reading and understanding these General Terms and Conditions of Contract, the user or customer undertakes to accept them, as well as to provide truthful information on all data concerning the contractual relationship with Impresión Store Talavera S.L.
13. Intellectual property and copyright. Impresión Store Talavera S.L. holds the copyright to the contents of this website in their entirety, which are protected by intellectual property law and, where applicable, industrial property law, as well as by the regulations governing domain names. The use of these contents by means of actions aimed at concealing their origin or source for commercial purposes, whether in whole or in part, is not permitted, nor is their transformation or exploitation for a purpose contrary to the law that could harm the interests of the owner or its image, through unfair competition, or that in general goes against the Ley de Propiedad Intelectual (Spanish Intellectual Property Act). The full or partial non-profit use of its contents is permitted, provided that it is done by means of links to cuadrossplash.com citing the source (articles 31 to 34 of Real Decreto Legislativo 1/1996, de 12 de abril (Royal Legislative Decree 1/1996 of 12 April, approving the consolidated text of the Spanish Intellectual Property Act)). The reproduction and marketing by other persons of the works displayed here without the permission of the rights holder is not permitted.
14. Applicable law. The contractual relationship of sale between the customer and Cuadros Splash is subject to Spanish law. For the resolution of any dispute, the parties shall submit to the Courts and Tribunals corresponding to the consumer’s place of residence.
