DATA PROTECTION POLICY
The processing of data is governed by the provisions of the EU General Data Protection Regulation 2016/679 of the European Parliament and of the Council of 27/04/2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and by the Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales (Spanish Organic Law on the Protection of Personal Data and the Guarantee of Digital Rights).
1. Data controller. Impresión Store Talavera S.L., with Tax Identification Code B75652354 and registered office at Calle Santa Águeda 2 bis, Local 2, 45600 Talavera de la Reina (Toledo). You can contact us by e-mail at cuadros@impresionstore.com.
2. What data we process and why. During the ordering process or when you open an account, we collect your personal data (name, address, telephone number, e-mail address, DNI, NIE or CIF and order details) in order to handle the processing and fulfilment of your order and to invoice you. The DNI, NIE or CIF is requested in the basket and we use it only to issue the invoice. If you have previously given us your express consent, we will also use your data to send you commercial communications by e-mail, which you can stop receiving at any time via the link included in each e-mail. If you are a Cuadros Splash customer, that is, if you have ever bought from us, we may also send you information by e-mail about paintings, new arrivals and offers from our own shop, similar to those you bought from us, even if you have not subscribed to our newsletter, as permitted by Article 21.2 of the Ley 34/2002, de Servicios de la Sociedad de la Información y de Comercio Electrónico (Spanish Information Society Services and E-commerce Act). You can object to this at any time, simply and free of charge: when placing your order, by writing to us at cuadros@impresionstore.com, or via the unsubscribe link included in each of our e-mails.
The legal basis for the processing is the performance of the sales contract, compliance with our legal obligations (tax and commercial) and, for commercial communications, your consent or, if you are already a customer, our legitimate interest in offering you products similar to those you bought from us (Article 21.2 of Ley 34/2002), to which you may object at any time.
The data will be kept for as long as the commercial relationship continues and, thereafter, for the number of years necessary to comply with our commercial and tax obligations. Once that period has elapsed, they will be deleted, provided that you have not expressly authorised their continued use.
3. Recipients of personal data. We do not disclose your data to third parties except where required by law. In order to provide you with the service, the following have access to it: the carrier responsible for the delivery of the goods; Shopify, the platform on which the shop is hosted, and Shopify Payments, which processes card payments (Cuadros Splash neither sees nor stores your card details); PayPal, if you choose to pay with PayPal; and Sendinblue SAS (Brevo), the service we use to send e-mails, if you subscribe or if, as a customer, we write to you for the reason set out in section 2. Some of these providers may process data outside the European Economic Area, with the safeguards required by the GDPR (standard contractual clauses approved by the European Commission).
4. Your rights. You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability in respect of your personal data, free of charge, by sending an e-mail to cuadros@impresionstore.com. If we have reasonable doubts about your identity, we may ask you to prove it. If you consider that we have not dealt with your request properly, you may lodge a complaint with the Agencia Española de Protección de Datos (Spanish Data Protection Agency) (www.aepd.es).
5. AI art assistant and wall preview tool. On this website you may, if you wish, use Ebora, our artificial intelligence art adviser, both in the chat and on the «Hang It in Your Home» page. Its use is voluntary and is not necessary in order to make a purchase.
Data processed: the messages you write in the chat and, in the preview tool, the photograph of your wall that you choose to upload together with the measurements you specify. Ebora will not ask you for personal data; we ask you not to include any in your messages and not to upload photographs showing people or documents.
Purpose and legal basis: to recommend works and sizes from our catalogue, to show you how they would look on your wall and to review chat conversations in order to improve the adviser. The legal basis is your consent, which you give by writing a message or uploading a photograph, and which you may withdraw at any time by ceasing to use the service.
Retention: except as indicated below for «Shall we e-mail it to you?», we do not store your photographs on any of our servers. Chat conversations are stored, without your IP address, in order to review them and improve the adviser, for as long as we maintain this service. The photograph is sent only once, in reduced size, for analysis, and is not stored. If you decide to save a wall in «My Home», the photograph and the image with the painting are stored only in your own browser, on your device, never on our servers; you can delete them at any time from that same page or by clearing your browsing data. We also record anonymous usage counters (for example, how many queries are made or which collections are searched for), without images or IP addresses. Conversations and counters are stored in a database hosted in the European Union.
«Shall we e-mail it to you?»: if you ask us to send you the image of your wall, we process your e-mail address, the image of your wall with the painting already in place and a reduced-size animation showing your wall first without the painting and then with the painting being hung, in order to send them to you at that moment. The legal basis is your request. We keep the images and the e-mail address for a maximum of 30 days, in a database hosted in the European Union, after which they are automatically deleted.
If you also tick the box «Yes, I'd like a 10% discount on my first painting and to receive Cuadros Splash offers, with a reminder of my wall in 3 days», which is optional and appears unticked, we include in that e-mail a 10% discount code for your first purchase, send you a single reminder of your wall a few days later and add you to our mailing list in order to send you commercial communications about new works and offers. The legal basis is your consent. If you buy before then, we do not send you the reminder; to find this out, we check whether your e-mail address matches that of an order in the shop. Your e-mail address remains on the list until you unsubscribe.
Proof of consent: in order to be able to demonstrate that you gave us your permission, as required by the GDPR, when you agree to receive our commercial communications (with that box or from the 10% notice on the website) we keep a record with your e-mail address, the date and time, the exact text you accepted, the page from which you did so, your IP address and your browser type. We keep this record for as long as we send you communications and, after you unsubscribe, for the period during which liability could be claimed against us (up to 3 years), solely for that purpose.
Unsubscribing: you can unsubscribe at any time via the link included in each e-mail, which immediately deletes the images of your walls and unsubscribes you from commercial communications, or by writing to us at the address given in section 4.
Data processors: in order to provide this service, the messages and the photograph are transmitted through Cloudflare, Inc., which hosts the service, and are processed by Anthropic, PBC, the provider of the artificial intelligence model. Both may process the data in the United States, with the safeguards of the standard contractual clauses approved by the European Commission. Anthropic does not use this data to train its models and may only retain it for a limited period, in accordance with its terms of service. The «Shall we e-mail it to you?» e-mails and those from our mailing list are sent through Sendinblue SAS (Brevo), based in France, within the European Union. You may exercise your rights over this data at the address given in section 4.
